With the adoption of interpretative decision No. 1/2016. the possibility of joint exercise of parental rights was officially confirmed.
Shared parenting, as it is known among the majority of society or joint exercise of parental rights, is a modern and much more civilized way of settling relations in the family after divorce or after the separation of partners in de facto conjugal cohabitation. It is possible for people who are intelligent, with high parental capacity and with equal opportunities to provide adequate household and social conditions for the child's life.
In modern society, more and more children are growing up in divided families or families in conflict. Divorce is much more common than it was 2-3 generations ago.
First of all, during its growth in such a family, the child is deprived of full contact with the father or with the mother, which can negatively affect his formation as a person. Every child needs both a mother and a father. And the two parental roles are naturally determined to be different – maternal care and paternal guidance. These two roles may be interchangeable, but this can hardly be achieved to the maximum extent. The insufficient involvement of the father or the mother in the life of a child gives rise to the risk of personality deficits.
